## Immigration at the polls: Colorado's ICE amendment trails, 287(g) sheriffs fall and five states add citizen-only voting

**Referenda:** Colorado voters were rejecting [Amendment 81](https://www.cpr.org/2026/11/03/colorado-election-results-amendment-81-law-enforcement-ice/), which would have written into the state constitution a requirement that police and prosecutors notify the Department of Homeland Security within 72 hours of charging someone whose immigration status can't be confirmed, if the charge is a violent crime or the person has a prior felony. The measure would have overridden state laws that limit cooperation with ICE. It needed 55% to pass and had about 44% in [the Denver Gazette's count](https://www.denvergazette.com/2026/11/03/immigration-cooperation-colorado-election-results/); the race had not been called. In Chicago, about 85% of voters backed an [advisory question](https://www.nbcchicago.com/elections/should-chicago-get-financial-compensation-for-ice-operations-midway-blitz/4011900/) urging the city to seek compensation from the federal government for Operation Midway Blitz. [West Virginia](https://westvirginiawatch.com/2026/11/03/west-virginia-voters-approve-noncitizen-voting-constitutional-amendment/), [South Dakota](https://southdakotasearchlight.com/2026/11/04/south-dakotans-approve-a-state-constitutional-ban-on-noncitizens-voting/), [Kansas](https://kansasreflector.com/2026/11/03/kansas-considers-wording-change-on-citizen-voting-something-already-included-in-state-constitution/), [Arkansas](https://thehill.com/homenews/campaign/6191180-arkansas-approves-issue-1-voter-eligibility/) and [Alaska](https://thehill.com/homenews/campaign/6190880-alaska-approves-citizenship-voting-requirement-ballot-measure-2026/) approved citizen-only voting language that largely restates existing law, [Bloomberg Law notes](https://news.bloomberglaw.com/social-justice/voter-id-election-security-ballot-measures-see-mixed-results). Arizona voters [rejected Prop. 144](https://thehill.com/homenews/campaign/6190915-arizona-rejects-citizenship-voting-requirement-ballot-measure-2026/), which paired a citizenship requirement with new ID rules, and California voters [rejected Prop. 39](https://www.latimes.com/california/story/2026-11-03/california-prop-40-billionaire-trails-tax-prop-39-voter-id), a voter-ID and citizenship-verification initiative. **287(g):** In Frederick County, Md., Democrat Karl Bickel [unseated Sheriff Chuck Jenkins](https://eltiempolatino.com/2026/11/04/locales/frederick-tendra-nuevo-sheriff-karl-bickel-derrota-a-chuck-jenkins/) with 55.6% of the vote. Jenkins ran a 287(g) program for 18 years, until Maryland banned the agreements in February; the county [dropped off ICE's roster](https://287g.recoveredfactory.net/en/agency/frederick-county-sheriffs-office-md) that month, according to 287(g) Watch. In Alamance County, N.C., unaffiliated candidate Shannon Long [defeated Sheriff Terry Johnson](https://www.elonnewsnetwork.com/article/2026/11/shannon-long-defeats-longtime-alamance-county-sheriff-terry-johnson), in office since 2002. Long opposed 287(g) “in its current form”; the county holds a [Warrant Service Officer agreement](https://287g.recoveredfactory.net/en/agency/alamance-county-sheriffs-office-nc) signed in 2020. In [Wake County, N.C.](https://287g.recoveredfactory.net/en/state/nc), Sheriff Willie Rowe, who opposed joining 287(g), [won a second term with 70.5%](https://www.newsobserver.com/news/politics-government/election/article317892735.html). LULAC told [Noticias Telemundo](https://www.youtube.com/watch?v=x9d29Yrf2_4) it had received reports of ICE agents at polling places; Mullin said in a [PBS NewsHour clip](https://www.youtube.com/watch?v=faMx6Mp22Pw) that he did not send agents there. Otherwise Election Day was [largely uneventful](https://www.usatoday.com/story/news/politics/elections/2026/11/03/election-day-2026-few-problems-dirty-tricks-or-federal-interventions/92459782007/), USA Today reports: ballot scanners failed in a New York county, polling places flooded in the Southwest and bomb threats hit Toledo, Ohio. **The voters:** In [exit polling](https://www.newsweek.com/how-ice-quietly-escaped-the-midterms-heat-12662094), 57% of voters said the administration's enforcement had gone too far and 60% disapproved of ICE. Only about 14% named immigration as the country's most important issue. Immigrant voters in New York and Chicago weighed enforcement alongside household costs, [Documented](https://documentedny.com/2026/11/03/nyc-voters-immigrants-midterm-priorities/) and [Borderless Magazine](https://borderlessmag.org/2026/11/03/heres-what-brought-some-immigrant-voters-to-the-polls-and-the-challenges-they-faced-on-election-day/) report; Borderless also found paper-ballot shortages at some polling places.
